Terms and Conditions

1 GENERAL

1.1. These conditions apply to all deliveries. Any order implies acceptance of the terms and conditions of sale.

2 DELIVERY and SHIPPING

2.1. Delivery takes place while stocks last.

2.2. Orders are shipped between Monday and Friday, excluding legal holidays. Rocks & Rolls is not responsible for unpredictable delays. The products are delivered a maximum of 14 days after the order day, unless there is force majeure.

2.3. The articles are sent according to the shipping costs overview per country and at the risk of the customer to the delivery address specified by the customer.

2.4. Subject to proof to the contrary, the delivery obligation will be fulfilled as soon as the goods delivered by the seller have been offered to the buyer once. In the case of home delivery, the carrier’s report, containing the refusal of acceptance, serves as full proof of the offer of delivery.

3 PRICE

3.1. Rocks & Rolls cannot guarantee the complete absence of errors on the shop. The seller may contain typographical errors, errors and inaccuracies related to the price, availability or details of an item. No liability is accepted for the consequences of such errors.

3.2. Prices quoted are current at the time of publication, after which they may be subject to change. Shipping costs are not included in these prices, but Dutch VAT (9%) is included.

3.3. All prices are per piece, unless stated otherwise.

3.4. If a product that has already been purchased appears to be discounted shortly after a product purchased, the customer cannot claim a refund of the price difference.

3.5. The seller is not responsible for any kind of customs fees or taxes that may be applied after shipment.

3.6. The seller reserves the right to correct errors or inaccuracies, even after an order has been placed. Consequently, the seller reserves the right to rectify errors or inaccuracies on the shop without prior communication of any kind.

4 RENEWAL RIGHT

4.1. In the event of a consumer purchase, in accordance with the Distance Selling Act, the consumer has the right to inform the seller that he renounces the purchase, without payment of a fine and without giving any reason within 4 working days from the day on which the purchase is made. following the delivery of the goods. 4.2. Items purchased during the sales period cannot be returned.

5 COMPLAINTS or DISPUTES

5.1. Complaints or disputes must be reported within 7 days of delivery. If the complaint is found to be well-founded, our liability is limited to the exchange of the goods. Any liability of the seller is limited to the amount actually paid for the order.

5.2. The European Commission has an online platform for resolving e-commerce disputes out of court, the so-called ODR platform (“Online Dispute Resolution”) http://ec.europa.eu/odr/. It is an interactive website that is available free of charge and in all official languages ​​of the EU. Consumers and entrepreneurs can find information about the options for settling their disputes out of court. In addition, consumers and businesses can submit a complaint with regard to an online transaction. This complaint is then delivered by the platform to the competent alternative dispute resolution entity, or ADR (“Alternative Dispute Resolution”) entity.

6 OVERDUE PAYMENTS

6.1. In the event of overdue payments, interest will be charged on the outstanding invoice amounts by operation of law and without any prior notice of default being required at the rate of 1% per month from the invoice date. In the event of non-payment and if a reminder by ordinary letter has not been followed up for 14 days, a fixed compensation amounting to 10% (ten percent) of the outstanding amounts with a minimum of € 50 (fifty euros) and a maximum of € 2,000 (two thousand euros).

7 PROPERTY RIGHT

7.1. The seller remains the owner of all goods until full payment is made.
