1. GENERAL TERMS & CONDITIONS

1.1. These terms and conditions apply to all deliveries. Every order placed implies acceptance of these terms of sale.

1.2. Rocks & Rolls (later “The Seller”) cannot guarantee the complete absence of errors on the website. The seller may include typographical errors, inaccuracies, or mistakes related to the price, availability, or details of an item. We accept no liability for the consequences of such errors.

1.3. All prices are per unit unless stated otherwise. Prices listed are valid at the time of publication and may be subject to change. Shipping costs are not included in the listed prices, but Dutch VAT (9%) is included.

1.4. If a purchased product is discounted shortly after purchase, the customer is not entitled to a refund of the price difference.

1.5. The seller is not responsible for any customs duties or taxes that may apply after shipping.

1.6. The seller reserves the right to correct errors or inaccuracies, even after an order has been placed. As such, the seller reserves the right to correct errors or inaccuracies on the website without prior notice.

2. DELIVERY AND (INTERNATIONAL) SHIPPING

2.1. Lead time:
  • Stock Items: 7 business days.
  • Custom Made Items (Including Custom Hard Candy, Custom Lollipops, PhotoLollies, etc.): 8 weeks.

Check the webshop for updates on current lead times.

2.2. Delivery will take place as long as stock is available. Orders are shipped Monday to Friday, excluding public holidays. Rocks & Rolls is not responsible for unforeseen delays. Products will be delivered within 14 days after the order date unless force majeure occurs.

2.3. Items are shipped according to the shipping cost overview per country and are at the customer’s risk to the delivery address provided. Delivery obligation is considered fulfilled once the products have been offered to the customer, unless proven otherwise. In case of home delivery, the carrier’s report, including refusal of acceptance, serves as full proof of the delivery offer.

2.4. Shipping costs are not included in the listed prices but Dutch VAT (9%) is included. Shipping costs will be calculated at checkout based on your location. Please make sure to enter a full and correct shipping address when placing your order. We cannot issue a refund or replacement for failed deliveries due to incomplete or inaccurate addresses.

2.5. You will receive an email with a tracking number once your order ships. If tracking shows that your order was delivered, we are not responsible for any lost or stolen packages.

2.6. International orders may be subject to import taxes, customs duties, and/or fees imposed by the destination country. These charges are not included in the product price or shipping cost, and the buyer is responsible for paying them once the goods arrive in the destination country.

2.7. It is the buyer's responsibility to check the laws, regulations, and restrictions of their country regarding the purchase of our products. By placing an international order, the buyer agrees to comply with their country’s customs laws and regulations.

2.8. If a product is seized or destroyed by customs, or returned to Rocks & Rolls, we will not be responsible for the loss, product, or shipping refunds. If a product is returned and the buyer wishes to have a second delivery attempt, the buyer is responsible for covering the shipping costs for the reshipment.

3. RIGHT OF WITHDRAWAL / RETURN / REFUND / COMPLAINTS & DISPUTES

3.1. Under the Distance Selling Act, the consumer has the right to cancel the purchase, without penalty and without giving a reason. However, perishable food items and/or consumables with limited shelf life are excluded from this right of withdrawal and are therefore not eligible for return or refund.

3.2. Refunds are only provided for defective, damaged, or unfit-for-purpose products. The product must be in its original condition and packaging, with a receipt or proof of purchase, and photo evidence of the item as received. Returns must be made in the original packaging and unopened, as the item left the warehouse. Items purchased during sale periods cannot be returned.
  • Stock Items (Items bought directly from the shop inventory):
    Returns and refunds are only possible for products that are in their original, unopened, and sealed packaging. Please ensure the product is in the same condition as when you received it.
  • Custom Candy (Items made to order and especially for you):
    For custom-made candy products, returns or refunds are not possible. As these products are specially made for you, they cannot be returned or refunded.

3.3. Complaints or disputes must be reported within 7 days of delivery. If the complaint is deemed valid, our liability is limited to replacing the goods. Any liability of the seller is limited to the actual amount paid for the order.

3.4. The European Commission has an online platform for resolving disputes outside of court, the so-called ODR platform ("Online Dispute Resolution") [here](http://ec.europa.eu/odr/). This is an interactive website available free of charge and in all official EU languages. Consumers and businesses can find information about resolving their disputes outside the court. They can also file a complaint about an online transaction. The platform will forward the complaint to the appropriate alternative dispute resolution (ADR) entity.

4. OUTSTANDING PAYMENTS

4.1. In the event of outstanding payments, interest will be charged automatically on the outstanding invoice amounts at a rate of 1% per month from the invoice date, without prior notice. In case of non-payment, and if a reminder by regular mail is ignored for 14 days, a flat-rate compensation of 10% of the outstanding amount, with a minimum of €50 and a maximum of €2,000, will be due.

4.2. The seller remains the owner of all goods until full payment is received.

5. COOKIES

6.1. Rocks & Rolls Candy respects your privacy and works hard to safeguard your personal data. We do not apply this policy to data collected through third-party websites like Facebook, Twitter, Instagram, or Google+, and encourage you to review their privacy policies.

6.2. We may use third-party companies to help us deliver our services, such as facilitating, performing, or analyzing service-related tasks. These providers have access to your personal information only to the extent necessary to carry out their tasks but are prohibited from using it for other purposes.

6.3. While most information on our site is available without providing personal details, certain personal data may be requested for customer management purposes (e.g., updates on our activities). You can opt out of direct marketing at any time by contacting us at info@rocksrollscandy.nl.

6.4. We do not share your personal data with third parties unless specifically stated.
